1. Scope of These Terms

1.1

These Editorial Submission Terms apply exclusively to the paid submission and curatorial review service offered by Catapult Contemporary for a submission fee of €10.

1.2

The service may be used for submissions including:

• current or past exhibitions
• Artist in Focus proposals and artist portfolios
• independent artistic projects
• special art projects
• other editorial proposals accepted through the Catapult submission form

1.3

These Terms do not apply to separately commissioned editorial articles, advertising services, Gallery Partnerships, memberships or other paid collaborations. Such services are subject to separate written agreements.

1.4

The person or organisation completing the submission is referred to as the “Submitter”.

Where the Submitter acts on behalf of an artist, gallery, institution, curator or another person or organisation, the Submitter confirms that they are authorised to make the submission and grant the rights described in these Terms.

1.5

Submitters must be at least 18 years old or have the consent of a parent or legal representative.

2. Description of the Submission Service

2.1

The €10 submission fee covers:

• administrative processing of the submission
• access and review of the submitted materials
• an independent editorial and curatorial assessment
• communication of Catapult’s selection or non-selection decision by email

2.2

The submission fee is a service fee for processing and curatorial review. It is not a payment for publication, advertising, promotion or guaranteed inclusion in the Catapult Living Archive.

2.3

Payment of the submission fee does not guarantee:

• selection
• publication
• inclusion in the Catapult Living Archive
• publication on social media
• newsletter inclusion
• individual feedback
• an explanation of the selection decision
• any particular reach, engagement or commercial result

2.4

All decisions are made according to Catapult’s independent editorial and curatorial judgment.

Relevant considerations may include artistic and editorial relevance, the quality and completeness of the submitted material, the suitability of the images, the availability of complete credits and rights information, and the submission’s suitability for the Catapult Living Archive.

2.5

Catapult is not obliged to provide individual feedback or an individual explanation for a selection or non-selection decision.

3. Submission Process

3.1

The Submitter completes the online submission form and provides an accessible link to the submission materials.

3.2

After submitting the form, the Submitter is redirected to Stripe to pay the €10 submission fee.

3.3

Submitting the form without completing the payment does not create a paid submission contract and does not place the submission in the review process.

3.4

The contract for the submission and curatorial review service is concluded only when:

1. the submission form has been completed;
2. the €10 payment has been successfully processed; and
3. an electronic payment and contract confirmation has been sent to the Submitter.

3.5

Submissions are normally reviewed in the order in which successful payment is received.

3.6

Catapult will normally communicate its decision within 14 calendar days after successful payment and receipt of complete and accessible materials.

The review may be completed and communicated earlier.

3.7

The review service is considered fully performed when Catapult has completed the assessment and sent the selection or non-selection decision to the email address provided by the Submitter.

3.8

The Submitter is responsible for providing a correct and accessible email address and for checking relevant spam or junk folders.

4. Submission Requirements

4.1

The Submitter must provide the materials requested on the submission page, including where applicable:

• high-quality images
• exhibition or project information
• artist names
• artwork titles and details
• venue and exhibition dates
• photographer names
• copyright and courtesy credits
• relevant website and social media information
• a project statement, press release or curatorial text

4.2

The submission folder must remain accessible until Catapult has communicated its selection decision.

4.3

All information supplied must be complete and accurate to the best of the Submitter’s knowledge.

4.4

If essential materials are missing, inaccessible or clearly incomplete, Catapult may request corrected or additional materials.

The Submitter must provide the requested materials within seven calendar days unless another period is specified in Catapult’s message.

4.5

If the required materials are not supplied within that period, Catapult may assess the submission on the basis of the available material or reject it as incomplete.

The submission fee is not refunded where administrative processing and review of the supplied materials have already taken place.

4.6

The Submitter may not submit material that is unlawful, defamatory, knowingly misleading, threatening, discriminatory, privacy-infringing or otherwise violates the rights of another person.

5. Price and Payment

5.1

The submission fee is:

€10 including applicable VAT

5.2

Payment is processed through Stripe.

The total price is displayed before the payment is completed.

5.3

A payment confirmation and invoice will be provided electronically.

5.4

Catapult does not charge any additional fee for the curatorial review. Currency-conversion costs, banking costs or other charges imposed by the Submitter’s payment provider are not controlled by Catapult.

5.5

If payment is unsuccessful, cancelled or reversed before the contract is confirmed, the submission will not enter the review process.

5.6

If a payment is later reversed or charged back without legal justification after the review service has been completed, Catapult may recover the outstanding amount and any reasonable costs caused by the unjustified reversal.

6. Consumer Withdrawal Rights

6.1

Submitters who enter into the contract as consumers have the statutory right to withdraw from the contract within 14 days without giving a reason.

The withdrawal period begins on the day the contract is concluded.

6.2

The consumer may expressly request that Catapult begin the curatorial review before the end of the 14-day withdrawal period.

6.3

Catapult will begin the curatorial review before the end of the withdrawal period only after the consumer has:

1. expressly requested the immediate beginning of the service; and
2. confirmed their understanding that the right of withdrawal ends once the review service has been fully performed.

6.4

The review service is fully performed when Catapult has completed the review and sent its selection or non-selection decision by email.

Once the service has been fully performed, the consumer no longer has a right of withdrawal, provided the legally required request, confirmation and information have been supplied.

6.5

If Catapult receives a valid withdrawal before the review service has been fully performed, Catapult will refund the €10 submission fee.

Catapult currently waives any proportional charge for a review that has only been partially performed.

6.6

No refund is due where:

• the review has been fully performed;
• the selection or non-selection decision has been sent; and
• the consumer previously requested the immediate beginning of the service and acknowledged the loss of the withdrawal right after complete performance.

6.7

Statutory consumer rights remain unaffected.

The complete withdrawal information and model withdrawal form appear at the end of these Terms.

7. Selection and Publication in the Living Archive

7.1

A submission is selected only when Catapult sends the Submitter written confirmation that the submission has been accepted for publication.

7.2

Selection remains subject to:

• receipt of complete publication materials
• confirmation of all required credits
• confirmation of the necessary image and publication rights
• the absence of substantiated legal or rights-related concerns
• the Submitter’s reasonable cooperation with the publication process

7.3

Once a selected submission has fulfilled these requirements, Catapult will publish the resulting feature in the Catapult Living Archive without an additional archive-publication fee.

7.4

A selected feature will remain publicly accessible in the Catapult Living Archive for a minimum of three years from its original publication date.

7.5

After the minimum three-year period, Catapult may continue to retain the feature in the Living Archive.

Catapult is not obliged to update, revise, redesign or actively maintain the editorial content after its original publication.

7.6

Catapult may update technical formatting, metadata, URLs, image sizes, internal categorisation and search information without changing the essential editorial meaning of the feature.

7.7

Catapult may restrict, suspend or remove a feature before the end of the three-year period where reasonably necessary because of:

• copyright, image-rights or trademark concerns
• incomplete or incorrect credits
• a substantiated third-party claim
• a legal or regulatory obligation
• materially incorrect or misleading information
• security or privacy concerns
• a serious technical limitation
• discontinuation or substantial restructuring of the platform
• a material breach of these Terms by the Submitter

7.8

Temporary technical interruptions, maintenance periods, hosting failures or temporary platform outages do not constitute permanent removal from the Living Archive.

8. Social Media and Digital Distribution

8.1

Selection for the Living Archive does not automatically guarantee social media or newsletter publication.

8.2

Catapult may, at its sole editorial discretion, publish or promote selected material through:

• the Catapult website
• Instagram
• Catapult newsletters
• Bluesky
• Substack
• TikTok
• YouTube
• other digital channels operated by Catapult

8.3

Catapult determines the timing, format, platform, image selection, caption, tagging, collaboration request and duration of any social media or newsletter publication.

8.4

Catapult is not required to publish on every listed platform or to maintain a social media post for a particular period.

8.5

Granting Catapult the necessary usage rights does not create a guarantee that Catapult will use the material on social media or through any particular distribution channel.

9. Intellectual Property and Image Rights

9.1 Ownership

All copyrights and other intellectual-property rights in the submitted materials remain with their respective owners.

No ownership of the submitted materials is transferred to Catapult.

9.2 Licence for the Review Process

By submitting materials, the Submitter grants Catapult a limited, non-exclusive and royalty-free licence to:

• access the submission folder
• download the submitted materials
• store and internally reproduce the materials
• share the materials internally with persons involved in the editorial review
• assess the materials for the purpose of curatorial selection

This review licence does not authorise Catapult to publish materials from a submission that has not been selected.

Catapult may retain a limited record of the submission and selection decision where reasonably necessary for accounting, legal compliance, fraud prevention and proof of the review process.

9.3 Licence Following Selection

If the submission is selected, the Submitter grants Catapult a non-exclusive, worldwide and royalty-free licence to:

• reproduce the selected materials
• publish and make the materials publicly accessible
• distribute and communicate the materials to the public
• archive the materials
• use the materials for editorial promotion of the selected feature
• publish the materials through the channels listed in Section 8

9.4 Duration of the Licence

For publication in the Catapult Living Archive, the licence is granted for a minimum period of three years from the original publication date.

After that period, the licence continues for as long as the relevant feature or associated promotional content remains published by Catapult.

9.5 Technical and Editorial Adaptations

The licence includes the right to:

• resize, crop and compress images
• create thumbnails and preview images
• adjust file formats and dimensions
• shorten video or audio material
• create excerpts for editorial promotion
• add titles, captions, credits, subtitles and graphic elements
• format, proofread, edit or shorten submitted text for editorial clarity, length and house style

Catapult will not intentionally alter the essential appearance of an artwork or materially misrepresent the submitted project.

Substantive changes to a signed or separately attributed curatorial or authorial text require the author’s or authorised Submitter’s agreement.

9.6 Third-Party Technical Services

Catapult may allow hosting providers, social media platforms, newsletter providers and other technical service providers to process and reproduce the material only to the extent necessary to provide the agreed publication and distribution.

9.7 Rights Confirmation

The Submitter confirms that they own, control or have obtained all rights, licences, permissions and authorisations necessary for Catapult’s use of the submitted materials under these Terms.

This includes, where applicable, the rights and permissions of:

• artists
• photographers
• videographers
• authors and curators
• designers
• copyright holders
• trademark holders
• galleries and institutions
• estates and collecting societies
• identifiable persons depicted in the materials
• any other relevant rights holder

9.8 Authority to Act for Other Parties

Where the Submitter acts for an artist, gallery, institution, curator, photographer or another rights holder, the Submitter confirms that they are authorised to submit the materials and grant the rights described in these Terms on behalf of the relevant party.

9.9 No Additional Rights Fees

Unless expressly agreed otherwise in writing, Catapult does not pay copyright fees, image-licensing fees, reproduction fees, photographer fees or other usage fees for submitted materials.

The Submitter confirms that Catapult’s authorised use will not create an undisclosed payment obligation to a third party.

9.10 Credits

The Submitter must provide complete and accurate:

• artist credits
• artwork information
• photographer credits
• copyright notices
• courtesy credits
• venue and institutional credits
• other attribution required by a rights holder

Catapult will use reasonable efforts to reproduce the supplied credits accurately.

9.11 Credit Corrections

The Submitter must inform Catapult without undue delay if a credit is incorrect or incomplete.

Catapult will correct confirmed credit errors within a reasonable period.

Catapult is not responsible for an initially missing or incorrect credit where the error results from incomplete or incorrect information supplied by the Submitter, provided Catapult corrects the error within a reasonable period after receiving complete and verified information.

9.12 Evidence of Rights

Upon request, the Submitter must provide:

• the name and contact details of the relevant photographer or rights holder
• reasonable evidence of the licence, consent or authorisation obtained
• information about restrictions affecting the material

Catapult may suspend or cancel publication where this information is not provided or the rights position remains unclear.

9.13 Third-Party Claims and Recourse

The Submitter is responsible for losses caused by a culpable breach of the rights confirmations and obligations in this Section.

To the extent legally permitted, the Submitter shall indemnify Catapult against justified third-party claims, damages, licence demands and reasonable legal costs arising from:

• missing or insufficient rights in the submitted materials
• incorrect rights information supplied by the Submitter
• missing permissions from photographers or other rights holders
• Catapult’s use of the material within the scope authorised by the Submitter

This obligation does not apply to the extent that a claim results from Catapult’s use of material outside the rights granted under these Terms or from Catapult’s own unlawful conduct.

9.14 Rights-Related Removal

Catapult may immediately suspend or remove material if it receives a plausible copyright, image-rights, privacy or other legal complaint.

Removal does not prevent Catapult from seeking reimbursement of justified costs or damages caused by a culpable breach by the Submitter.

10. Editorial Control

10.1

Catapult retains final editorial control over:

• selection
• article structure
• headings
• introductory text
• layout
• image order and image selection
• formatting
• publication timing
• platform selection
• social media presentation

10.2

Catapult is not obliged to use every image, text, link, artwork or other item included in the submission.

10.3

Catapult may request factual corrections, shorter texts, replacement images, additional credits or other reasonable changes necessary for publication.

10.4

Selection does not give the Submitter a right to dictate Catapult’s independent editorial opinion, presentation or platform strategy.

11. No Performance Guarantee

11.1

Catapult provides editorial review and, where selected, editorial visibility.

Catapult does not guarantee:

• website traffic
• search-engine ranking
• social media reach
• engagement
• followers
• sales
• exhibition attendance
• press coverage
• collector enquiries
• professional representation
• commercial or career outcomes

11.2

Catapult is not responsible for algorithm changes, platform restrictions, deleted third-party accounts, external reposts or decisions made by Instagram, Bluesky, Substack, TikTok, YouTube, Stripe or other third-party providers.

12. Liability

12.1

Catapult is liable in accordance with applicable statutory law.

Nothing in these Terms excludes or restricts liability where liability cannot legally be excluded or restricted.

12.2

Catapult is not responsible for incomplete, inaccurate or unlawful information or material supplied by the Submitter, except to the extent that Catapult is independently at fault.

12.3

Catapult is not responsible for unauthorised copying, reposting or other use of publicly available material by unrelated third parties that Catapult does not control.

12.4

Statutory rights of consumers remain unaffected.

13. Data Protection

13.1

Personal data supplied through the submission form is processed in accordance with Catapult’s Privacy Policy.

13.2

The Submitter is responsible for ensuring that they are permitted to provide Catapult with personal data relating to photographers, artists, representatives and other persons named in the submission.

13.3

Acceptance of the Privacy Policy is not treated as consent to unrelated advertising or newsletter marketing.

14. Electronic Communication

14.1

Contract confirmations, invoices, review decisions and other communications may be sent electronically to the email address supplied by the Submitter.

14.2

The Submitter must notify Catapult if the supplied email address changes before the review process has been completed.

14.3

An email is considered sent when it leaves Catapult’s email system, unless Catapult receives a technical non-delivery notice.

This does not restrict any mandatory consumer right.

15. Applicable Law and Jurisdiction

15.1

These Terms and the submission contract are governed by Austrian law.

15.2

For consumers, this choice of law does not remove any mandatory protection granted by the law of the country in which the consumer has their habitual residence.

15.3

For consumers, the statutory rules concerning jurisdiction apply.

15.4

For Submitters acting as businesses, the courts having subject-matter jurisdiction for Vienna, Austria, shall have exclusive jurisdiction to the extent legally permissible.

16. Changes and Applicable Version

16.1

The version of these Terms displayed and accepted at the time of successful payment applies to the relevant submission.

16.2

Later amendments do not change an existing submission contract unless required by law or expressly agreed by both parties.

16.3

Catapult may update these Terms for future submissions.

The date of the most recent update will be displayed at the beginning of the Terms.

17. Final Provisions

17.1

Individual written agreements expressly accepted by Catapult take precedence over conflicting provisions in these Terms.

17.2

If any provision is invalid or unenforceable, the remaining provisions remain unaffected to the extent legally permissible.

ANNEX 1

INFORMATION CONCERNING THE RIGHT OF WITHDRAWAL

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which the contract was concluded.

To exercise the right of withdrawal, you must inform:

of your decision to withdraw from this contract by an unequivocal statement, for example by email or a letter sent by post.

You may use the model withdrawal form below, but its use is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse the payment received from you without undue delay and no later than 14 days after the day on which we are informed about your decision to withdraw.

We will make the reimbursement using the same means of payment used for the original transaction unless another method has been expressly agreed. You will not incur any fee from us as a result of the reimbursement.

Where you have expressly requested that the curatorial review begin during the withdrawal period, your right of withdrawal ends once the review service has been fully performed and the selection or non-selection decision has been sent to you.

Catapult currently waives any proportional service charge where a valid withdrawal is received before the review service has been fully performed and will refund the full €10 submission fee.
